1. DIVORCE MEDIATION
Mediation is a non-binding process led by a neutral and impartial third-party family mediator. The family mediator helps couples clarify their positions and underlying interests of each spouse. A family mediator encourages parties to consider alternative perspectives with a view to reaching common goals such as co-parenting the children of the marriage. The mediator attempts to guide the couples to a resolution. At the end of mediation, couples may have resolved all, or some, of the matters in dispute.
At Leap! Divorce Solutions Ltd. we use a step-by-step strategic mediation model. Our Divorce Mediator-Arbitrator facilitates the discussions. You make the decisions on matters such as the division of marital property, parenting, format and structure of communication, and a framework to resolve issues in the future. In addition, our Divorce Mediator-Arbitrator will provide you with information on the federal guidelines and underlying obligations with respect to child support and spousal support.
2. BINDING RESOLUTIONS
If a resolution has been reached through mediation, our Divorce Mediator-Arbitrator will make it legally binding with a Consent Arbitration Award. This is a formal document that makes the resolutions reached in mediation a final and legally enforceable settlement between the separating couples and dictates how they will deal with their mutual affairs on an on-going basis.
If there is an impasse in mediation on a specific issue or issues, then you can appoint our Mediator-Arbitrator as arbitrator to make binding decisions to resolve the outstanding issue(s). Arbitration offers the opportunity to resolve the family disputes through an arbitration hearing. An arbitrator can make binding decisions under the Arbitration Act of Alberta.
